Acceptance of Terms:

By accessing or using our website, you acknowledge that you have read, understood, and agree to comply with the terms and conditions outlined herein. These terms govern your use of our website and the purchase of gift cards offered through our platform.

By using our website, you agree to abide by and be bound by these terms and conditions, our Privacy Policy, and any additional policies or guidelines posted on the website. If you do not agree with any part of these terms, please do not use our website.

Modification of Terms:

Earn and Trade LLC reserves the right to modify, update, or change these terms at any time without prior notice. Changes will be effective immediately upon posting to the website. Your continued use of the website following the posting of any changes constitutes acceptance of those changes.
User Accounts:

Account Creation:

To access certain features of our website, including the purchase of gift cards, you may be required to create a user account. During the account creation process, you will be asked to provide accurate and current information, including but not limited to, your name, email address, and other relevant details. You agree to provide truthful and complete information during the registration process and to update this information to keep it accurate, current, and complete.

You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree not to share your account information with third parties or allow anyone else to access your account. You are responsible for all activities that occur under your account, and you agree to immediately notify us of any unauthorized use of your account or any other breach of security.

User Responsibilities:

Security: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or suspected breach of security.

Accurate Information: You agree to provide accurate, current, and complete information during the account registration process and to update such information to keep it accurate, current, and complete.

Prohibited Actions: You agree not to use the website for any unlawful or unauthorized purpose. You may not use the website in any manner that could damage, disable, overburden, or impair our servers or networks, or interfere with any other user’s use and enjoyment of the website.

Access Restrictions: We reserve the right to terminate or suspend your account at our sole discretion without prior notice if we believe that you have violated these terms or engaged in any activity that is illegal, fraudulent, or harms the interests of Earn and Trade LLC.

Earn and Trade users must not mislead Earn and Trade, any advertisers, affiliates, third parties, or other users due to false name, email, phone number, zip code, birthday, photos, posts, etc. Users on Earn and Trade must submit accurate information upon signing up and post non-misrepresenting photos and posts. Profiles that are created to mimic someone is prohibited. Furthermore, Earn and Trade users are limited to only one (1) account, Earn and Trade users are also limited to utilizing advertisers, affiliate networks, affiliates, and third parties on Earn and Trade for points one (1) time. 

Additionally, Earn and Trade accounts can not be sold or transferred under any circumstance. If accounts are suspected or successfully transferred or sold without prior permission from an Earn and Trade representative they are subject to removal or both Pending Points and Points without notification

As detailed in the User Rules and The Point System section, Earn and Trade has the right to remove points from any account that violates the Terms and Conditions of Earn and Trade. Earn and Trade also elects to remove points from any accounts due to inactivity, inactivity is defined as an account that have not been logged into or accounts that have not earned or traded points in one year six months time (1 year 6 months). This entails Earn and Trade removing the points earned by users and having those deducted points go into Earn and Trades personal point pool as a result of inactivity on Earn and Trade. Earn and Trade will send a 30 day written notice in the form of a warning email before removing points due to inactivity; however, if the warned account ignores or fails to restart activity, Earn and Trade will consider the account inactive and deduct the points.

As a user of Earn and Trade, you are agreeing to full responsibility and understanding that you claim all risk for anything including loss of points, loss of account, the hack of account, loss of personal information, etc. Earn and Trade does not claim any responsibility for anything that happens to accounts. The management of your account entails all information including all information given to Earn and Trade on Sign Up, as well, but not limited to all information posted throughout Earn and Trade. As a user, you agree to maintain your account and consistent security practices such as password rotation every 3 months. In the event of any of the listed events, it is your responsibility to utilize Earn and Trades resources and reach out to [email protected] as soon as possible. Earn and Trade is not liable for any losses of points or information of all kinds.

The point system on Earn and Trade is referred to as two different types of points, pending points and available points both points have no cash value and can only be “traded” for items on the Earn and Trade users may redeem points for Gift Cards. Earn and Trade delivers Gift Cards to the email address provided to Earn and Trade in the form of a redemption code.

Pending points are used as a placeholder and not tradable, this is done since our advertisers, affiliates, and third parties take time to pay out on commissionable actions. Points are tradable and get automatically converted from the not tradable pending points. Both points are distributed in a first earned first distributed method; however, points may not be instantaneously distributed, Earn and Trade has a process for verification to ensure our safety, therefore, pending points may be distributed in 1-48 hours and points may be distributed in 1-35 days depending on the advertisers, affiliates, and third parties.

As a user by your own free will/self-determination can utilize Earn and Trade to earn points that are redeemable after you as a user complete actions on Earn and Trade through our advertisers, affiliates, and third parties. Points will only be awarded if the advertisers, affiliates, and third parties deem the action as commissionable, this is ONLY determined by the advertisers, affiliates, and third parties, not Earn and Trade; therefore, Earn and Trade is not responsible for any payouts, money lost due to paid trial sign up, free trial sign up, purchases or any action is done through shopping. Earn and Trade is not responsible or obligated to give pending points/points to users who have claimed to complete a commissionable action, our advertisers, affiliates, and third parties are tracked through a network that is responsible for the majority of the tracking and disbursement of points, Earn and Trade doesn’t control commissionable action tracking. Earn and Trade tracks user ID for point disbursement purposes.

Earning points is done through using affiliate links provided by our affiliate networks, these affiliate networks supply terms for commissionable actions which are displayed on Earn and Trade, after users complete the commissionable action they are awarded pending points as our affiliate networks often place a 30 day holding period on their commissions. After the commissionable action is paid within our network we automatically convert the pending points to points. 

Earn and Trade users may also be subject to point deductions regardless of points and regardless of when the points were earned any time throughout your history as a user without notification, this may be due to various reasons including, but not limited to, a limited number of disbursements done by advertisers, affiliates, and third parties and charging back Earn and Trade.  Advertisers, affiliates, and third parties reverting point disbursement due to various reasons including chargebacks, refunds, users not being a fit for advertising, fraud, wrong point value dispersed, etc. Earn and Trade also reserves the right to refuse future and current service,  Earn and Trade reserves this right if users are suspected of not being compliant with Earn and Trades Terms and Conditions along with any other terms Earn and Trade sets in the future.

Earn and Trade elects to remove points from accounts that have not been logged into or accounts that have not earned or traded points in one year six months time (1 year 6 months). This entails Earn and Trade removing the points earned by users and having those deducted points go into Earn and Trades personal point pool as a result of inactivity on Earn and Trade. Earn and Trade will send a 30 day written notice in the form of a warning email before removing points due to inactivity; however, if the warned account ignores or fails to restart activity, Earn and Trade will consider the account inactive and deduct the points. Earn and Trade also elects to make changes to the point removal clauses in this paragraph due to any unforeseen policy changes Earn and Trade, advertisers, affiliate networks, affiliates, and third parties may change. Earn and Trade may also remove points without notification or consent. As a user, you can request to dispute your point removal and it will be handled on a case by case basis by an Earn and Trade representative with our terms and conditions in mind. Users can dispute this through [email protected]

Email and Notification:

As you sign up for Earn and Trade, you agree to accept and receive emails with the emails you provide Earn and Trade, as for any advertisers, affiliates, third parties you reach through Earn and Trade, you as a user on their website/service abide by their GDPR email terms if you commit an action on their website/service triggering accepting and receiving emails Earn and Trade is not responsible for any messages, notifications, or marketing that happens in conjunction. The emails Earn and Trade will send include but are not limited to sign up welcome email, follower notification email, like notification email, @ mention email, new advertiser/affiliate email, purchase confirmation email. As a user of Earn and Trade, you may choose the option to opt out of receiving emails from Earn and Trade; however, choosing this option will impact your user experience.

Data Policies:

Earn and Trade is committed to prioritizing our user’s privacy; its recommended you read the Privacy Policy, but to summarize, Earn and Trade elects to collect various non-personal data for necessary business functions. However, when non-personal data works in conjunction with personal data, Earn and Trade will utilize the non-personal data as personal data.

Earn and Trade operates a Traders Forum, publicly viewable profiles, searchable user directory, and activity feeds. Earn and Trade users, by their own free will/self-determination; users can choose to upload a first and last name, cover photo, profile photo, user description. While all wall posts, trader’s forum posts, earning history, trading history, and photos are publicly viewable. ANY information under the Traders Forum, publicly viewable profiles, searchable user directory, and activity feeds are not protected and publically accessible and publicly viewable; therefore, any information is posted or uploaded at your own risk; additionally, this information may be collected by third parties since Earn and Trade has no control over what third parties do on the website. If you do not agree with Earn and Trades publicly viewable data, you can decide to refrain from posting any content you as a user do not wish to be publicly viewable or choose to not create an account since this publicly viewable data is a critical component of Earn and Trades community functionality.

Tracking:

The information Earn and Trade collects may be used to track our user’s activity. Users on Earn and Trade are tracked after clicking on buttons containing affiliate links on advertisements and transported to the corresponding website whereby the user’s free will/self-determination they can choose to interact or participate with the guidelines set by the advertiser on the affiliate network, which is displayed on Earn and Trade. The links are modified with Earn and Trade assigned Ids which is given to users on registration to determine the activity that is correlated to our Earn and Trade users, such as which links they clicked, which advertisers they interacted with, as well as what users traded their points for on the Earn and Trade website.

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

Earn and Trade’s business model is primarily conducted through affiliate links supplied by advertisers through various affiliate networks. Earn and Trade rewards users based on the terms given by Advertisers, Affiliates, and Third Parties. Earn and Trade is not responsible for any of our  Advertisers, Affiliates, and Third Parties or any other linked website, or services, you may connect with through Earn and Trade, All actions including transactions are between you and the Advertisers, Affiliates, and Third Parties, Earn and Trade claims no liability and is not responsible for any money lost, delivery of products, dissatisfaction with products or service, or refunds. Earn and Trade; therefore, we do not claim any actions, privacy policies, terms and conditions, payouts, or other practices or views linked to Earn and Trade. 

Earn and Trade’s business model is primarily conducted through affiliate links supplied by advertisers through various affiliate networks. Earn and Trade rewards users based on the terms given by Advertisers, Affiliates, and Third Parties, for example, sign-ups with perimeters defined by our advertisers or percentage back on shopping specific item categories as defined by our advertisers. Earn and Trade is not responsible for any of our third party, advertiser, the linked website, services, or affiliate you may connect with through Earn and Trade; therefore, we do not claim any actions, privacy policies, Terms and Conditions, payouts, or other practices or views linked to Earn and Trade.

Once users click a link that transports them to a third party, advertiser, linked website, services, or affiliate, they are now abiding by the privacy policy, terms and conditions, and all other rules and policies of the third party, advertiser, linked website, services, or affiliate, and Earn and Trade does not claim responsibility for their privacy policy, terms and conditions, and all other rules and policies.

Earn and Trade encourages all of our users before completing any commissionable action or visiting any website linked to Earn and Trade to read the privacy policy as well as the terms and conditions to any third party, advertiser, linked website, services, or affiliate.

Images and other intellectual properties

Earn and Trade does not claim the rights to any images, artwork, videos, logos, photos, text, or any information on the Earn and Trade website or on any of our social media accounts as most images displayed are of our advertisers, affiliates, or third parties which are trademarked and assumed to be owned by the brand associated with the images, artwork, videos, logos, photos, text, or any information on Earn and Trade. If any of the images on the Earn and Trade website are infringing on your brand or your personal work please let the Earn and Trade team know at [email protected] so we can immediately take down the image and answer any questions if you have about any images, artwork, videos, logos, photos, text, or any information.

Earn and Trade users also has features for users to upload images to the Earn and Trade website, users can upload images to the profile picture section, cover photo section, profile wall, and the activity feed. The Earn and Trade team does its best to monitor the photos being uploaded; however, Earn and Trade claims no responsibility for any users uploading images that are deemed offensive.If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Taxes

Earn and Trade users are completely responsible for all liability regarding both federal and state taxes derived from the Earn and Trade website. Earn and Trade is not responsible for any mispayments or legal trouble derived from taxes on Earn and Trade. By accepting the Terms and Conditions, you also accept full liability regarding reporting taxable income to the IRS. This includes, but is not limited to Gift Card redemptions, points earned, rebates, Gift Cards Purchased, and trades. The IRS requires you to report any earnings derived from Earn and Trade since it falls under the gross income category on your 1040. If necessary, Earn and Trade will issue a 1099 to users who reach the threshold; however, users will need to report tax information which may require additional information in order to properly file this form.

User Rules

1. Earn and Trade exclusively operates for residents and persons in the United States of America and its territories  All features from Earn and Trade, not referring to our advertisers or affiliates since they are separate entities, are operated in and controlled from various locations worldwide.
2. Earn and Trade only offers its services to users eighteen (18) or older, users under this age limit are not permitted and are subject to removal of points and account/accounts.
3. Users on Earn and Trade must not infringe on any policies with Earn and Trade, any advertisers, affiliates, or third parties.
4. Users on Earn and Trade must not use Earn and Trades services just to accumulate points, users should ONLY interact/participate in point-earning activity IF they genuinely want to use the services, buy the products, and intend to use trials as the advertisers.
5. Users on Earn and Trade must not utilize the services of Earn and Trade, any advertisers, affiliates, or third parties on Earn and Trade for any purpose that is deemed illegal or in violation of any state or national law, this also includes the laws that protect and govern intellectual property and privacy and data protection
6. Users on Earn and Trade must not utilize exploits for any reason, this includes exploiting point systems, exploiting advertisers, or attempting/successfully gaining access to the backend features of Earn and Trade.
7. Users on Earn and Trade must not use multiple accounts or create fake accounts which mislead Earn and Trade, any advertisers, affiliates, third parties, or other users due to false name, email, phone number, zip code, birthday, photos, posts, etc. Users on Earn and Trade must submit accurate information upon signing up and post non-misrepresenting photos and posts. Profiles that are created to mimic someone is prohibited.
8. Users on Earn and Trade must abide by Trader Forum rules and must not post NSFW content, violent content, illegal activities, religion-based, racist, spam, spam links, personal referral links, speech aimed to embarrass, mock, threaten, demean, or stalking other users on Earn and Trade, anything deemed offensive by moderators, and political topics unless relevant to conversations about finance.  
9. Users on Earn and Trade must not attempt or successfully upload or spread viruses, worms, trojan horses, or files, photos, documents, or downloadable content containing content harmful to both users and Earn and Trade. This also includes users who attempt or successfully manufacture programs that intend to hack, crack, or take advantage of Earn and Trade, advertisers, affiliates, or third parties in order to gain points or information on Earn and Trade or from our advertisers, affiliates, or third parties.
10. Users on Earn and Trade must not attempt to hack or attempt to gain access into other Earn and Trade accounts under any circumstances. This includes but is not limited to attempting to get emails, first name, last name, zip codes, birthdays, points, birthday, phone numbers, gender, password, or any other information on Earn and Trade. 
11. Users on Earn and Trade must not submit false requests under the Report Point Mistakes form, trader forum, or through any support email under any circumstances, this includes but is not limited to trying to get points that were not earned, gain access to accounts not yours, or submit false claims.  Users must also talk to Earn and Trade representatives with respect, Earn and Trade trusts the judgment of our representatives and they will flag anything deemed offensive which may be but is not limited to anything under speech aimed to embarrass, mock, threaten, demean, use racist language, or spam our representatives.
12. Users on Earn and Trade must not give false payment information to both Earn and Trade as well as advertisers, affiliate networks, affiliates, and third parties. This includes but is not limited to first and last name, street address, city,  state, zip code, email, and card numbers.
13. Users on Earn and Trade must not infringe the rights of Earn and Trade, any advertisers, affiliates, or third parties on Earn and Trade, this includes, but is not limited to the intellectual property, any contracts you agree to, trademarks, copyrights, patents, trade secrets, and other information. 

Purchase and Redemption of Gift Cards:

4. Price Adjustments:

4.1 Modification of Prices: Earn and Trade LLC  reserves the right to modify the prices of gift cards at any time. Changes will be effective immediately upon posting on the website. However, the prices for gift cards already in your cart will be honored at the time of purchase.

4.2 Errors: In the event of a pricing error on our website, we reserve the right to cancel or refuse any orders placed at the incorrect price. In such cases, we will notify you of the error and provide the opportunity to proceed with the order at the correct price.

Shipping:

1. Gift Card Delivery:

1.1. Digital Delivery: Our gift cards are delivered digitally, either as a unique code or a printable electronic document. This method ensures quick and convenient access to your purchased gift card.

2. Estimated Delivery Times:

2.1 Instant Delivery: In most cases, digital gift cards are delivered instantly upon the completion of the transaction; however in some cases our distributor can delay transactions . You should receive the confirmation email with the gift card details promptly.
